Virtual Visit Verification Process Disclaimer

The Virtual Visit Verification Process (as defined in the Virtual Visits Verification Process Vendor Terms And Conditions) has been established by Ontario Health (OH) to give clinicians and healthcare organizations in Ontario access to expanded options for virtual care in support of the province’s Digital First for Health strategy and to support health services planning.

A list of vendors will be published on the Solution Site maintained by OH, which vendors’ solutions have met the mandatory Virtual Visits Solution Requirements. This list is meant to serve only as a guide for clinicians and health care organizations in selecting and procuring approved virtual visit solutions and should be reviewed in conjunction with those vendors’ policies and processes to determine and evaluate whether a vendor or solution is suitable and complies with Virtual Visits Solution Requirements. All vendors listed will have agreed to the Virtual Visits Verification Process Vendor Terms and Conditions and provided a self attestation to OH that its solution meets the mandatory solution requirements needed to support safe, privacy and security enhanced virtual visits highly relevant and important to clinicians and healthcare organizations as it makes its decision. The solutions are not intended to replace in person medical care. The mandatory solution requirements and other recommended requirements can be found here at otn.ca/verification.

Participation in the Virtual Visits Verification Process is completely voluntary. Use of a verified vendor solution by clinicians and healthcare organizations is also completely voluntary however may impact eligibility to provincial programs. In the event of a conflict between this disclaimer and the Website Terms and Conditions, the terms of this disclaimer shall govern, but only as it relates to the Virtual Visits Solutions Verification process.

OH may, at any time without notice or liability, and for any reason whatsoever, terminate, change, suspend or discontinue any aspect of the Virtual Visit Verification Process. In no event shall OH (including directors, officers, employees and subcontractors) be liable for any damages or loss howsoever caused (including damage and loss caused by, but not limited to, any errors, loss of data, inaccuracies or omissions in any information, advice, instructions, content or scripts, whether provided by a vendor or OH) arising in any way from the site, the discontinuation of the verification process, any content on the site or by a clinician’s or healthcare organization’s use of or reliance on a solution listed on the Solution Site. OH is not responsible or liable for any advice, services or products that clinicians or healthcare organizations obtain through the use of a solution listed on the Solution Site.

The vendors are solely responsible for ensuring that the solutions comply with all applicable laws (including, but not limited to, the Personal Health Information Protection Act, 2004 (PHIPA)) and that they are fit for their intended purposes. The submission by a vendor of a privacy impact assessment and threat and risk assessment summary and participation in the solution verification process does not mean the solution is in compliance with PHIPA or that if a clinician or healthcare provider uses a solution that they are in compliance. While OH may provide feedback on a submission, information submitted is accepted “as is” for completeness purposes.

OH (including directors, officers, employees and subcontractors) are not the creators, owners, editors, managers, providers (or agents of providers) of the solutions (or information and content contained therein) listed on the site.

For clarity, the listing of a solution will not mean that OH has conducted due diligence on the solutions or a submission by the vendor; nor does it mean OH has identified all aspects to be considered, or reviewed and verified all aspects of all versions of (including any updates) of the solutions, or that they are suitable for use by all types of patients, clinicians or healthcare organizations.

Clinicians and healthcare organizations may have unique obligations not included or contemplated in this process and as such should consult with their respective privacy and/or legal advisors or counsel as they assesses their readiness to deploy or use a virtual visit solution. Clinicians and healthcare organizations should continue to make its own independent decisions about any vendors it chooses to provide solutions including conducting its own due diligence regarding vendors’ and their associated solution’s compliance with applicable laws (including, but not limited to, PHIPA).

The vendor of a solution once listed on the Solutions Site is the entity solely responsible for the content, advice, production, and maintenance (including all required updates) of the solution. Clinicians and healthcare organizations must exercise their own skill and judgement when using the solution. Additionally, it must ensure that the procurement of any solution listed on the site is conducted in compliance with its own legal and regulatory requirements.
